Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Mylo: AI Calorie Tracker (the "App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Description of Service

Mylo is a calorie and macro tracker. You can log food by taking a photo of a meal, scanning a barcode, describing a meal by voice or text, or searching a food database. The App calculates daily calorie and macro targets from the information you give it and tracks your weight and progress.

3. Accounts

You must create an account to use the App. You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information when creating your account.

4. Subscriptions and Payments

Mylo is free to use with a limited number of AI scans (photo, voice or text) each day. Mylo Pro is a subscription that makes AI scans unlimited. Barcode scanning, food search, targets and weight tracking are included for free.

• Subscriptions are billed on a monthly or annual basis through Apple's App Store.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
• You can manage and cancel your subscriptions in your Apple ID account settings after purchase. Deleting your Mylo account does not cancel your subscription.
• No refunds will be provided for any unused portion of a subscription period, except as required by applicable law.

5. Free Trial

If offered, a free trial period allows you to use Pro features at no charge. If you do not cancel before the trial ends, your subscription will begin and you will be charged at the applicable rate.

6. Not Medical Advice

Calorie, macro and portion estimates, especially those from photos and descriptions, are approximate and may be wrong. Targets are general estimates based on standard formulas. The App is for general information and tracking only; it is not medical, nutritional or health advice and is not a substitute for a doctor or registered dietitian. Talk to a qualified professional before making significant changes to your diet, particularly if you are pregnant, have a medical condition or have a history of disordered eating. We are not liable for any harm resulting from reliance on the App's estimates.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or its servers, including by automating scans
• Reverse engineer, decompile, or disassemble any part of the App
• Upload photos that are unlawful or that you don't have the right to share

8. Intellectual Property

The App and its content, features, and functionality are owned by Viking Tech and are protected by copyright, trademark, and other intellectual property laws. You keep ownership of the photos and data you add; you give us permission to process them to run the App as described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Viking Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or in connection with your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Termination and Account Deletion

We may terminate or suspend your account if you violate these Terms. You may delete your account at any time in Settings → Delete Account, which permanently deletes your account and data.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated terms in the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the updated terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
